“Today, 5th District Congressional candidate Brose McVey released a letter to Indiana attorney General Greg Zoeller, calling on him to join other attorneys general in opposing the health care legislation moving through Congress.”

Dear General Zoeller:

By way of this letter, I urge you to join forces with  Florida Attorney General McCollum and others in considering legal action against provisions of the current health care reform legislation pending in Congress, should it become law.

The legislation, as recently passed by the United States Senate, undermines rights, authorities and freedoms enshrined in our Constitution.  The mandate that every American purchase health insurance, the unequal treatment of the States under provisions relating to Medicaid reimbursement, and the preemption of state laws, each ignore the clear intent of our founders.

In the coming days, as the Congress races to reach final agreement, you and other attorneys general have a unique opportunity to press these arguments to the leaders in Congress and the White House, and use your unique credibility to argue for changed prior to enactment.  I urge you in the strongest terms to make this case forcefully and use every tool at your disposal to oppose this outrageous and dangerous affront to our state’s economy and our people’s freedom.

If as expected, Congress passes and the President signs legislation that maintains there unconstitutional provisions, I urge you to be party to legal actions to challenge the law immediately, prior to implementation.  I will seek your counsel and guidance in determining whether I will take legal action, together with voters in Indiana, as citizens adversely affected by this troubling legislation.

Sincerely,

Brose

McVey finished by raising the prospect of leading a citizens’ legal challenge to the legislation, should it become law. “I will seek your counsel and guidance in determining whether I will take legal action, together with voters in Indiana, as citizens adversely affected by this troubling legislation,” said McVey.
